FERGUSON, Judge:

Tried by general court-martial, the accused was found guilty of unpremeditated murder, in violation of Uniform Code of Military Justice, Article 118, 10 USC § 918, and sentenced to dishonorable discharge, forfeiture of all pay and allowances, confinement at hard labor for ten years, and reduction to the grade of private. The convening authority approved the sentence. A Navy board of review, in order to correct an instructional error, affirmed findings of guilty of voluntary manslaughter, in violation of Code, supra, Article 119, 10 USC § 919, and reduced…
