Appeal from a judgment of the superior court for Kitsap county-, Yakey, J., entered February 29, 1908, in favor of the plaintiffs, upon stipulation and a trial on the merits before the court without a jury, in an action on fire insurance policies.

This action was commenced by Port Blakely Mill Company,' a corporation, and Detroit Trust Company, a corporation, to recover on certain insurance policies for a loss sustained by fire. From a judgment in favor of the plaintiffs, the defendant has appealed.

The appellant contends that the trial court erred in denying its challenge to the sufficiency of the evidence, in entering judgment for respondents, and in refusing to enter judgment in its favor.
