This matter comes before the court on the plaintiffs motion for partial summary judgment on Count X of the plaintiffs first amended complaint, submitted pursuant to Rule 56 of the Rules of the United States Court of Federal Claims (RCFC), and on defendant’s cross-motion for summary judgment on the same count.
