This matter is before the court upon motion of the plaintiff, Melinda M. Newton, to remand this case to the General Court of Justice, Superior Court Division of Mecklenburg County, North Carolina. Plaintiff’s complaint alleges that while employed by the defendants Coca-Cola Bottling Company Consolidated (“Coca-Cola”) and First-In Temporaries, Inc., 1 her immediate supervisor, Reggie Patton, sexually assaulted her and subjected her to acts of quid pro quo and hostile environment sexual harassment.
