Background Facts

Plaintiff Brandy Finley filed the original complaint in this action against her former employer “[t]he Higbee Company d/b/a Dillard’s Department Store” (hereinafter referred to as “Dillard’s”) and former supervisor Kathy Marsh on June 23, 1997 in the Cuyahoga County Court of Common Pleas.
