This is an appeal from an order denying a petition to intervene in a divorce action, and also from an order denying a rehearing therein.
The complaint for divorce was filed by plaintiff husband on January 9, 1947, and pleads two causes of action: (1) extreme cruelty prior to separation which is alleged to have occurred on April 3, 1941, and (2) desertion.
The amended answer of defendant wife denies the two causes of action and alleges two affirmative defenses: (1) entry of a final judgment of divorce between the parties in the State of Missouri in 1943, and (2) estoppel, based upon plaintiff’s…
