Plaintiff filed a petition under the Uniform Declaratory Judgments Act of June 18,1923, P. L. 840, to deter mine the constitutional validity of a township zoning ordinance as applied to a certain piece of land owned by him. At the threshold of this case, the question arises as to the availability of such a remedy under the circumstances here presented.
