The Borough of Beaver, proceeding under the Act of June 29, 1923, P. L. 957, enacted a zoning ordinance regulating the location, construction, and uses of buildings and land. The relator’s property was located in the residential district. He made an application to the zoning inspector for a permit to build a gasoline service station on this lot. It was refused. An appeal was taken to the board of adjustment and that board also refused to issue the permit. Mandamus proceedings to compel the issuance of the permit Avere then instituted.
