The appeal is by plaintiff and appellant Pearl M. McManus from a judgment in favor of the defendants and respondents H. W. Otis and Smoke Tree Properties, Inc., a corporation, alias Mardo Corporation.
The action is one for injunction and to recover damages for injuries to real property alleged in the complaint to have been sustained as a result of the construction by defendants of two parallel dykes whereby the “rain and storm waters” flowing out of Palm Canyon and over the alluvial cone thereof were in 1937 and 1938 collected and concentrated into a narrow channel and so diverted from their…
