McGOHEY, District Judge.

This is an action for injunctive relief and damages based on two claims. The first is that the defendant, unlawfully and to the plaintiff’s irreparable damage, willfully and knowingly advertises, offers for sale, sells and delivers the plaintiff’s products in New York to New York residents for less than the retail prices fixed by the plaintiff in contracts made pursuant to the fair trade laws of New York, 1 New Jersey and other states.
