This is an appeal, on the judgment-roll, from a judgment in favor of plaintiff in an action brought by him to recover the possession of certain personal property, to wit: two hundred and five tons of baled straw and fifteen tons of loose straw, or the value thereof, in case a delivery of the same could not be had.
