The parties will hereinafter be referred to as they appeared in the trial court, plaintiff in error as respondent or Orville Geisler, and defendant in error as petitioner.

The action was commenced in Grand County by John B. Barnard, an attorney, who filed a petition in the name of “The People of the State of Colorado in the interest of Michael William Geisler, a minor.” The petition alleged, among other things, that the respondent has caused or is causing and contributing to the dependency of Michael William Geisler, aged two months, whose residence is in the City and County of Denver and that…
