The material facts in this case are set forth in a statement which, pursuant to stipulation of counsel, has been included in the certified record. In November, 1948, the parties entered into an arrangement whereby the plaintiff was to do certain work in connection with the repairing and remodeling of defendant’s store and apartments. Labor was performed by plaintiff and by his helper in accordance with the agreement.
