ORDER

ROY, District Judge.

Pending before the Court are the parties’ motions for summary judgment. The United States claims that the defendant is indebted to it for monies he received under the Federal Insured Student Loan Program (Public Law 89-329, IY-B) which were not repaid to the lender, Advance Schools, Inc. The United States as guarantor of the defendant’s debt paid off the remaining indebtedness on September 4,1979, after having been notified by the lender of default on September 2, 1975.
