GARDNER, Circuit Judge.

This is an action to recover on a contract of war risk insurance.

James Lawson Pullig, the insured, enlisted in the United States Army December 15, 1917, and was discharged August 18, 1918, on a surgeon’s certificate of disability because of dementia prascox, -and poor physical condition.
