BARRON, Justice.

This is an action brought by plaintiffs, Harold W. Kahla and wife, Julia W. Kahla, the latter being injured in a hit and run collision with a pickup truck alleged to have occurred on February 2, 1967. This suit was filed in the District Court of Harris County, Texas, on September 19, 1969. The owner of the involved pickup truck was James Edward Compton, but the truck was allegedly being operated at the time of the collision by Gary Warner.
