This is an action to recover for personal injuries and special damages arising out of an automobile accident. Trial before the court and a jury resulted in a verdict and judgment of dismissal. Plaintiff’s motion for a new trial was denied. Plaintiff appeals.

Appellant, Albert E. Grapp, is a resident of Minneapolis, Minnesota. On July 26, 1942, he was visiting his brother, Roy Grapp, of Seattle.
