This is an action to recover damages for injuries to person and property resulting from a collision between a bicycle ridden by plaintiff and an automobile driven by defendant’s agent. The jury returned a verdict for plaintiff. On motion of defendant, the court granted judgment dismissing the complaint, notwithstanding the verdict of the jury. The plaintiff has appealed.

The accident occurred in March, 1928, more than six years before the commencement of the action and about seven years prior to the time of the trial. The only witnesses who testified concerning the details of the accident were…
