This is an appeal by the Southern Pacific Railroad Company and the Southern Pacific Company, defendants herein, from the judgment for plaintiff and from an order refusing a new trial.

The complaint on its face states a cause of action to quiet title to a tract of land in the city of Santa Cruz, forty feet wide and three hundred and ninety feet long, comprising all of the wharf, known as the railroad wharf, at x Santa Cruz, except the part which extends into Monterey Bay beyond the line of ordinary low tide.
