The opinion of October 19, 2012, is withdrawn, and the following is substituted therefor.
Myrtis Hill1 sued the following entities and individuals in the Jefferson Circuit Court: Fairfield Nursing and Rehabilitation Center, LLC (“Fairfield”); D & N, LLC (“D & N”); DTD HC, LLC (“DTD”); Donald T. Denz; Norbert A.
