OPINION

ANDEWELT, Judge.

These two related cases have been consolidated for consideration of defendant’s motion to dismiss. In the respective actions, plaintiffs, National Leased Housing Association and 230 present or former owners of rental housing projects, and Acacia Villa along with 58 other developers of rental housing projects, seek back rent payments for housing units rented to low income families pursuant to federal contracts.
