This appeal is presented by a bill of exceptions. Appellant, Mollie A. deFrees Brownrigg, is the issue of the marriage of John M. deFrees, deceased, and his former wife, Susan S. deFrees. In the year 1888, the wife brought an action against her husband for a decree of divorce. Mollie, who is a mute, was then a minor of about the age of fifteen years. The ground of the divorce action was cruelty and a decree of divorce was awarded the wife on that ground. She was also awarded the custody of said deaf and dumb minor child.
