MEMORANDUM OPINION AND ORDER

JOYCE HENS GREEN, District Judge.

This action is brought pursuant to 42 U.S.C. § 405(g) whereby plaintiff seeks Social Security disability payments which he alleges were improperly denied to him by the defendant, through her Administrative Law Judge, whose decision became final as the Secretary’s decision when subsequently upheld by the Appeals Council of the Social Security Administration of the Department of Health and Human Services (HHS).
