Class action plaintiffs, nonunion employees, appeal the order of the district court to *402the extent it grants final judgment in favor of various officials of the Commonwealth of Pennsylvania, (the “Commonwealth”), and Council 13 of the American Federation of State, County and Municipal Employees, (“Council 13”), (collectively “the defendants”).
