MARKEY, Chief Judge.

John 0. McLean and Chemical Engineering Corporation (Chemical) sued Mario, Inc. (Mario) in the U.S. District Court for the Eastern District of Wisconsin for an injunction against threatened patent infringement, damages, costs, attorney fees, and other relief. The district court issued summary judgment in favor of Mario and awarded Mario its costs and attorney fees. Chemical filed a notice of appeal.
