This case on appeal from the United States District Court for the District of New Jersey raises two important issues. First, we must decide whether we have jurisdiction under The Federal Courts Improvement Act of 1982, Pub.L. No. 97-164, § 127, 96 Stat. 25, 37 (28 U.S.C. § 1295) to decide whether a federal district court has jurisdiction of a case under 28 U.S.C. § 1338(a) (1976).
