This appeal is from a judgment herein in favor of the plaintiff and against the defendant and appellant B. J. Dunn, and also from an order denying the said defendant’s motion to sot aside said judgment upon the ground hereinafter to be stated. The action was one for money-had and received and was commenced by the plaintiff on June 5, 1923, against all three of the defendants, doing business as copartners under the firm name and style of Dunn, Hurst & Martin, who were all duly served with process.
