James A. Nolen, III appeals from the September 29, 2003 opinion and order of the Court of Common Pleas of Delaware County, which incorporated the court’s June 29, 2003 opinion and order sustaining Newtown Township’s preliminary objections and dismissing Nolen’s petition for appointment of a board of view.
