On December 30, 1958, Ethelyn E. Fingold applied under G. L. c. 32, § 9 (1), to the State board of retirement (the State board) for an accidental death benefit as the widow of Mr. George Fingold. At his sudden death on August 31, 1958, shown by the death certificate to have been caused by “cerebral embolism — rheumatic valvular heart disease,” he was Attorney General of the Commonwealth. She alleged that Mr. Fingold’s death resulted from accidental injuries sustained on July 16, 1958, while in the performance of and within the scope of his duties.
