This is a claim under the workmen’s compensation act, for compensation for partial “incapacity for work.” G. L. c. 152, § 35. The employee, Herbert W. Percival, on January 16, 1925, while employed by the H. E. Shaw Company received an injury arising out of and in the course of his employment which resulted in the amputation of his right leg below the thigh. The insurer, American Mutual Liability Insurance Company, paid to the employee compensation for total incapacity up to July 10,1925, and in addition thereto the compensation specifically provided for the loss by severance of his leg above…
