CLIFFORD, Justice.

[¶ 1] Nancy Berg appeals from the judgment entered in the Superior Court (Kennebec County, Alexander, J.) vacating a judgment entered in the District Court (Augusta, Anderson, J.) granting to Berg visitation rights with her granddaughter Bianca Rose Badershall. The Superior Court based its ruling on constitutional grounds. Berg challenges the Superior Court ruling and argues that because Lee-Ann Bragdon, the child’s mother, did not challenge the constitutionality of the statute during the trial in the District Court, the issue has not been preserved.
