MEMORANDUM AND ORDER
ANN ALDRICH, District Judge.
Plaintiff Advanced Technology Corporation (“ATC”) brings this action seeking cost recovery and, in the alternative, contribution from defendant Eliskim, Inc. for response costs incurred by ATC under the Comprehensive Environmental Response Compensating and Liability Act of 1980, as amended, 42 U.S.C. § 9601, et seq. (“CERCLA”). ATC also seeks declaratory relief that Eliskim is liable for future response costs. Both parties have filed motions for summary judgment.
