This matter is before the Court on the objection of defendant Domenic Lombardi Realty, Inc. to a Report and Recommendation issued by United States Magistrate Judge David Martin. The Report and Recommendation concludes that this Court should grant plaintiff United States Environmental Protection Agency’s (“EPA”) Motion for Summary Judgment on the issue of defendant’s liability under the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”), which is contained in 42 U.S.C. § 9607.
