Hutchison, J.:

The Farmers State Bank, of Wichita, appeals to this court from a judgment rendered against it in the district court of Sedgwick county for $750 in favor of the plaintiff, Joe Meinhart, for damages sustained on account of injury to his credit because of the failure and refusal of the bank to honor his checks drawn thereon *334when he had in said bank funds sufficient to cover such checks at the time they were drawn and presented. This case has been to this •court before and was reversed and remanded, the syllabus being as follows:
