The plaintiff, Newton Walton (“Walton”), brought this action against his former employer, defendant Carolina Telephone and Telegraph (“CTT”), alleging fraud and misrepresentation in connection with his transfer to CTT from North Electric Company (“NEC”). The gist of Walton’s complaint is that CTT induced his transfer by promising him that, upon completion of five years’ work at CTT, Walton’s period of employment (important for purposes of determining seniority and entitlement to other benefits) would be measured from the time he began at NEC (1970), rather than the time he…
