Rogosheske, Justice.

This is an appeal from an order determining that plaintiff’s action for personal injuries arising under our Civil Damage Act,1 popularly *217known as the Dram Shop Act, survives the dramshop operator.2

The only question presented is whether, pursuant to our survival-of-action statute, Minn. St. 573.01, such an action survives the person against whom it arose.
