Before the court are plaintiffs application to proceed informa pauperis, plaintiffs motion for immediate preliminary injunction, defendant’s motion to dismiss, and defendant’s motion for judgment upon the administrative record. In this case, plaintiff, a veteran of the United States Army (“Army”) and the Arizona Army National Guard (“National Guard”), filed a pro se complaint alleging that his retirement pay was unlawfully garnished by the Defense Finance and Accounting Service (“DFAS”).
