Respondent, identified as Panel File No. 99-5, represented Bio-Recovery Inc. (client) in a breach of contract action. In anticipation of a scheduling and settlement conference, his client advised respondent that it wished to reach a settlement at the conference and included proposed settlement terms. Respondent did not communicate the settlement offer to the magistrate or opposing counsel at the conference.
