MEMORANDUM OPINION

WILLIAMS, District Judge.

Plaintiff Timothy Mazer (“Plaintiff’ or “Mazer”) has brought this suit against Safeway, Inc. (“Safeway” or “Defendant”), alleging that Safeway failed to pay Mazer compensation and benefits in violation of the Employment Retirement Income Security Act (“ERISA”), 29 U.S.C. §§ 1001-1461 (2005), and Maryland law. Currently pending before the Court is Defendant’s Motion for Partial Summary Judgment [37]. The Court has reviewed the entire record, as well as the Pleadings, with respect to the instant motion.
