This matter comes before the court on plaintiffs motion to remand. For the reasons stated below, plaintiffs motion to remand is GRANTED.
I. Factual and Procedural History 1
On December 5, 2005, plaintiff Felix Venezuela (“plaintiff’) entered into an Executive Employment Agreement (the “Employment Agreement”) with defendant Massimo Zanetti Beverage USA, Inc.
