SUTTON, Justice.
This is an appeal from a judgment of the District Court of Dimmitt County, entered on an instructed verdict for the defendants.
The proceeding was had on the First Amended Petition in Intervention filed by Booth Fisheries Corporation, a Delaware Corporation, in a suit pending in the District Court of Dimmitt County, No. 2663, and styled Elizabeth M.
