The plaintiff in the court below who. is appellant here, was during the years 1885 and 1886, a merchant in the city of Jefferson and depositor in the bank of the defendant corporation. He was absent during the period of the transactions involved in this suit, that is to say, from December, 1885, to August, 1886, but his business was in charge of his brother, A. Weinstein, who was his agent and attorney in fact.
