This matter comes before the Court on a motion by the plaintiffs, Michael and Lori Hugo, for partial judgment on the pleadings or, in the alternative, motion for partial summary judgment as to defendant, United States of America. On December 27, 1983, the plaintiffs filed their petition for relief under Chapter 11 of the Bankruptcy Code.
