The characters in this litigation may be described as follows: The Newport Construction Company is a corporation; Porter, Conley and McLean are the three members of a partnership. In the contract upon which the plaintiff seeks to recover, the Newport Construction Company and Conley were parties of one part, and Porter and the same Conley and McLean were parties of the other > part. It thus appears that Conley was a contracting party on both sides of the contract.
