MEMORANDUM OPINION AND ORDER
ASPEN, District Judge:
Robert J. Bilka (“Bilka”), a former accountant for defendant Pepe’s Inc. (“Pepe’s”), has sued Pepe’s under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. He alleges discrimination on the basis of his national origin: American. Pepe’s has moved to dismiss the com plaint for failure to state a claim for relief and for lack of jurisdiction. For the reasons stated below, the motion is granted in part and denied in part.
