Introduction

William P. Freiburger, Alfred R. Heikki-nen, James A. McLaughry, Larry A. Slocum, and Yince L. Terrel, plaintiffs, filed a five-count amended complaint against Emery Air Charter, Inc., defendant. Count I claims that plaintiffs were terminated for participating in union organizing activity in violation of the Railway Labor Act, 45 U.S.C. § 151(a)(2). Counts II through V are supplemental state claims. Count II alleges retaliatory discharge based on plaintiffs’ union organizing activity.
