OPINION AND ORDER
TURNER, Judge.
This case involves a contract for the termination of milk production entered into between plaintiff James Doty1 and the Department of Agriculture (USDA) pursuant to the dairy termination program (DTP).2 See 7 U.S.C. § 1446(d)(3)(A)3; 7 C.F.R. §§ 1430.450—.470. Plaintiff alleges that the government breached the contract when it denied payment of amounts due under the contract and when it demanded a refund of amounts previously paid.
