The plaintiff, Stephen Kerns, instituted this negligence action against the Consolidated Rail Corporation (Conrail) under the Federal Employers’ Liability Act (FELA), 45 U.S.C.A. § 51 et seq., for personal injuries sustained on June 14, 1977 when glass from the right lens of a pair of safety glasses became lodged in the plaintiff’s right eye while he was working on a Conrail production gang as a trackman.
