Plaintiff, Otis Elevator, appeals from a summary judgment entered in Superior Court, Cumberland County, dismissing its action for contribution against F.W. Cunningham & Sons (hereafter Cunningham). This action for contribution arose out of an underlying action for wrongful death and conscious pain and suffering brought by Cheryl Minott, administratrix of the estate of Paul Minott, against Otis Elevator and Cunningham. 2 Following a trial in that action, the jury by special verdict determined: (1) Paul Minott, Cunningham and Otis Elevator were each guilty of negligence which…
