Appeal by defendant from a judgment of tbe district court for Ramsey county in favor of plaintiff, entered in pursuance of tbe findings and order of Kelly, J.

Tbe plaintiff is tbe assignee of tbe St. Paul Electric Manufacturing & Construction Company. Tbe proceedings were bad under Laws 1881, c. 148,2 and its amendments. Tbe defendant on October 18, 1893, obtained a judgment by default against tbe insolvent for tbe sum of $1,395, and this action is brought to set it aside, as a preference given to one of tbe insolvent’s creditors.

Tbe insolvent company was a corporation organized under tbe laws of this state, and was engaged in tbe business of manufacturing electric light and power, and furnishing tbe same to its patrons. Tbe suit was commenced…
